A judge once told me that you are not supposed to get a speeding ticket if you were going down hill. Now that I have gotten a ticket for that exact thing, does any one know what to say to properly defend myself and get the ticket dismissed? I was going 54 in a 40 zone, down a pretty significant hill.

Was your foot on the break when you were going down hill? That’s where it should have been.
If you are exceeding the speed limit, you can get a ticket. Even going down hill.
Your vehicle is equipped with brakes. It is your responsibility as a driver to keep your vehicle under the speed limit.
You will be unable to get the ticket dismissed based on the hill alone.
That judge lied to you. If what he said was true, then the cop wouldn’t have written you a ticket. The fact is, you have brakes, and you’re responsible for hitting them when you’re on a hill. It’s a well known fact that cops like to camp out at the bottom of hills for this very reason.
Sorry, but if you try to use that as a defense, the judge will laugh at you and say, “Nice try.”
You need to prove that you were doing all you could to control the speed. Let the judge know that you had dropped the car into a lower gear, and you had your foot on the brake applying just enough pressure to not lose control of the car. Had you braked harder, the car felt unstable, and you felt like it was more dangerous for others on the road.
Tell the judge the facts, the hill, etc Unless you were going at a extreme over the limit like 30 MPH its best to just pay the fine.
It doesn’t matter if you were going downhill and with the wind. The speed limit is still the speed limit and if you exceed it, you can get cited for it.
There is no “I was going downhill” defense.
The “judge” you heard this from is either not a judge … or was pulling your leg so hard you should have felt it!
They put speed limit signs on down hill grades, right? You are required to be in full control of your car at all times while driving … right?
Your defense strategy will fail, you will be found guilty of speeding, and all the normal penalties will apply!
